This privacy policy will explain how Monta uses the personal data we collect from you when you use our website, user portals and mobile applications.

To make the policy more easy to read we use "Monta", "we", "us", "our" to describe our company. When we talk about our "website" we mean www.monta.com and the other sites and applications we own and operate. When we refer to "user portals" and "mobile applications", we mean our product "Monta".

When we refer to "you" and "your" we mean you as a user of our website, user portals, mobile applications and/or customer of our other goods and services.

For the purpose of the EU General Data Protection Regulation 2016 (GDPR), the data controller is Monta.

1. What data do we collect? How do we collect your data?

Monta may collect, store and use the following kinds of data:

Personal identification information that you provide to us when registering and completing your profile on our website, user portals or mobile applications (such as your name, email address, phone number, address, and other contact information).

Information that you provide when completing your profile on our website, user portals or mobile applications (such as business name, business address, profile pictures, gender, date of birth, and vehicle information).

We may also obtain some of this information if you choose to use a single sign-on (SSO), such as Google, Apple or Microsoft to create or access your account.

Information that you provide to us when using the services on our website, user portals or mobile applications or that is generated in the course of the use of our services (including the timing, frequency, location and pattern of EV charging).

Information relating to any purchases you make of Monta's goods and services or any other transactions (such as charge keys) that you enter into our website, user portal or mobile applications (such as name, contact details, address, cost, and transaction details but excluding payment information).

We use Stripe as a third party credit card payment processing company to collect payment information. If you submit payment information, we will share with Stripe information such as your debit/credit card number, billing address, phone number, and installed application information in order to process payments.

We collect your phone number and installed application information in order to process payments to your Monta Wallet inside of the application.

Information about your computer and about your visits to and use of our website, user portals or mobile applications (such as your IP address, geographical location, browser type and version, operating system, referral source, length of visit, page views and website navigation paths).

Information that you provide to us for the purpose of subscribing to our email notifications and/or newsletters (such as your name and email address).

Information contained in or relating to any communication that you send to Monta or send through the Monta websites, user portals or mobile applications (such as information you provide when contacting us for support).

Before you disclose the personal information of another person to Monta, you must obtain that person's consent to both the disclosure and the processing of that personal information in accordance with this privacy policy.

2. How will we use your data?

Monta may use your data to:

  • Administer our website, user portals, mobile applications and business;
  • Personalize the Monta website, user portals and mobile applications for you;
  • Enable your use of the services available on the Monta website, user portals and mobile applications;
  • Send you goods and supply to you services purchased through the Monta website, user portals or mobile applications;
  • Send statements, invoices and payment reminders to you, and collect payments from you;
  • Send you non-marketing commercial communications;
  • Send you email notifications and information that you have specifically requested (such as via our lead generator, or by contacting us for support);
  • Send you email newsletters, if you have requested it (you can unsubscribe at any time);

  • Deal with enquiries and complaints made by or about you relating to your use of Monta's services (including investigating and fixing technical issues);
  • For the establishment, exercise or defense of legal claims;
  • Keep Monta website, user portals and mobile applications secure and prevent fraud; and
  • Verify compliance with the terms and conditions governing the use of Monta's website, user portals or mobile applications.

Monta will not sell or otherwise provide your personal data to third parties, and will only make it available to third parties involved in the performance of the goods and services agreed with you. We may collect anonymized and aggregated usage data.

3. How do we store your data?

Monta maintains industry standard security safeguards to protect your data. We encrypt data in transit and at rest, where appropriate, to ensure that your information is kept private. Monta securely stores your data on our secure (password- and firewall-protected) servers. All payment information is fully encrypted and handled only by PCI certified organizations.

Monta seeks to limit the period for which the personal data are stored to a minimum. Thus, Monta processes your personal data only to the extent and as long as is necessary to meet the purposes of the data processing.

In broad terms, we will only retain your personal data for as long as is necessary for the purposes described in this privacy policy. This means that the retention periods will vary according to the type of the data and the reason that we have the data in the first place. We have procedures in place regarding our retention periods which we keep under review taking into account our reasons for processing your personal data and the legal basis for doing so.

We retain your information as long as required to provide the goods and services requested by you, for record keeping purposes, to comply with our legal obligations, resolve disputes, and enforce the terms for our services. After it is no longer necessary for us to retain information about you, or otherwise upon your request, we will dispose of it in a secure manner or anonymize the information.

Information that Monta collects may be stored and processed in and transferred between any of the countries in which we operate in order to enable us to use the information in accordance with this policy.

You acknowledge that the transmission of information over the internet is inherently insecure, and Monta cannot guarantee the security of data sent over the internet. Emails sent via the internet might not be encrypted, so we advise you not to include any confidential or sensitive information in your emails to us.

Access controls are in place to limit access to your information to those who need it to perform their jobs. For example, information about you may be provided to our customer support team to help you with your requests.

4. Who processes your personal data?

Monta uses third-party service providers, such as managed hosting providers, credit card processors, and technology partners to provide the software, networking, marketing, logistics, infrastructure and other services required to operate, develop, deliver and maintain our product and services, and fulfill our other purposes as defined in this privacy policy. When a third party processes personal data on our behalf, we ensure that the processing of personal data is conducted safely and in accordance with all applicable privacy laws and best practices of data processing (including but not limited to GDPR).

In addition, personal data may be disclosed to authorities when we are required to do so by law, based on demands made by competent authorities in accordance with existing privacy laws.

Monta may also use other service providers for the processing of personal data outside the European Union or the European Economic Area. Such transfer of personal data is always conducted on the basis of any of the following legal grounds:

  • The European Commission has established that an adequate level of data protection will be ensured in the recipient country concerned;

  • The right to rectification – You have the right to request that Monta correct any information you believe is inaccurate. You also have the right to request Monta to complete the information you believe is incomplete.

  • The right to restrict processing – You have the right to request that Monta restrict the processing of your personal data, under certain conditions.
  • The right to object to processing – You have the right to object to Monta's processing of your personal data, under certain conditions.
  • The right to data portability – You have the right to request that Monta transfer the data that we have collected to another organization, or directly to you, under certain conditions.
